Terms Of Service

1. Acceptance of These Terms

These Terms of Service (“Terms”) govern your access to and use of the website beverlyhillslawpartners.com and related services (collectively, the “Service”) operated by Beverly Hills Law Partners (“BHLP,” “we,” “us,” or “our”). By accessing or using the Service, submitting a form, or otherwise interacting with us, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference.

If you do not agree to these Terms, do not use the Service. If you are using the Service on behalf of a law firm or other entity, you represent that you have authority to bind that entity to these Terms.

2. Nature of the Service

BHLP operates a matching service that connects individuals seeking legal help (“Clients”) with independent, third-party attorneys (“Attorneys”). The Service allows Clients to submit information about a legal matter and be connected with one or more Attorneys who may be able to assist.

  • BHLP is not a law firm and does not practice law, provide legal advice, or provide legal representation.
  • No attorney-client relationship is created between you and BHLP by using the Service. An attorney-client relationship is formed only if and when you and an Attorney separately agree to it.
  • No endorsement or guarantee: BHLP does not guarantee the quality, competence, or outcome of any Attorney’s services, and inclusion of an Attorney is not an endorsement or recommendation of that Attorney.

 

3. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements and that the information you provide is accurate and complete.

4. Terms for Clients

  • Consent to be contacted: By submitting the intake form, you request to be connected with one or more Attorneys and consent to be contacted by BHLP and by matched Attorneys by phone, email, or text using the contact information you provide, including where a tracked phone number is used.
  • No fee to Clients: BHLP does not charge Clients for being matched. Any fees for legal services are set by, and paid directly to, the Attorney you engage.
  • Your decision: you are under no obligation to hire any Attorney you are matched with, and you are solely responsible for evaluating and selecting an Attorney.
  • Accurate information: You agree to provide accurate information about your legal matter so that we can attempt an appropriate match.

5. Terms for Attorneys

  • Licensing and compliance: you represent that you are licensed and in good standing in each jurisdiction where you accept matters, and that your participation and communications comply with all applicable rules of professional conduct and advertising rules.
  • Purchased leads/credits: Attorneys may purchase lead credits or packages as described at the time of purchase. Details of pricing, credits, and any refund or credit policy are set out in the separate Attorney Agreement, which governs in the event of a conflict with these Terms on those subjects.
  • No guarantee of results: BHLP does not guarantee any number of leads, the quality or conversion of any lead, or that any lead will result in a retained client.
  • Independent relationship: Attorneys are independent third parties. Nothing in these Terms creates a partnership, employment, joint venture, or agency relationship between BHLP and any Attorney.
  • Responsibility for client relationships: once connected, the Attorney is solely responsible for the attorney-client relationship, including conflicts checks, engagement terms, fee arrangements, and compliance with professional obligations.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful, fraudulent, or misleading purpose.
  • Submit false, inaccurate, or another person’s information without authorization.
  • Attempt to gain unauthorized access to the Service, other accounts, or our systems.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Scrape, harvest, or collect information about other users.
  • Use the Service to send spam or unsolicited communications in violation of the law.

7. Intellectual Property

The Service, including its content, design, logos, and trademarks, is owned by BHLP or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. You may not copy, modify, distribute, or create derivative works from the Service without our prior written consent.

8. Third-Party Attorneys and Links

The Service connects you with independent Attorneys and may contain links to third-party websites. We do not control and are not responsible for the acts, omissions, services, advice, or content of any Attorney or third party. Any engagement you enter with an Attorney is solely between you and that Attorney.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. BHLP DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY MATCH WILL MEET YOUR NEEDS.

BHLP MAKES NO WARRANTY REGARDING ANY ATTORNEY OR THE LEGAL SERVICES THEY PROVIDE. ANY RELIANCE ON AN ATTORNEY IS AT YOUR OWN RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BHLP AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE OR ANY INTERACTION WITH AN ATTORNEY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BHLP’S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO BHLP IN THE [PLACEHOLDER] MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

11. Indemnification

You agree to indemnify and hold harmless BHLP and its owners, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.

12. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of the respective region, without regard to its conflict-of-laws rules. 

Any dispute arising from or relating to these Terms or the Service will be resolved as set out in this Section. The parties will first attempt to resolve any dispute informally. If that fails, the dispute will be resolved by [binding arbitration / the courts located in that region], and you agree to the exclusive jurisdiction and venue of those forums.

13. Changes, Suspension, and Termination

We may modify these Terms at any time by posting the updated Terms and revising the “Last updated” date. Your continued use of the Service after changes take effect constitutes acceptance. We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms.

14. Miscellaneous

  • Entire agreement: these Terms, the Privacy Policy, and (for Attorneys) the Attorney Agreement constitute the entire agreement between you and BHLP regarding the Service.
  • Severability: if any provision is found unenforceable, the remaining provisions remain in full effect.
  • No waiver: our failure to enforce any provision is not a waiver of that provision.
  • Assignment: You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
